Commercial data brokers, AI companies, and aggregators send automated crawlers to municipal websites around the clock. They download property records, permit data, meeting minutes, budgets, and contracts — information that would be available through a FOIL request — and package it into products they sell for profit. Your municipality covers the server costs, the bandwidth, the staff time to keep the site running. The crawlers pay nothing.

The key insight: a FOIL request and a bot crawling your website are not the same thing. FOIL gives every person the right to request specific records. It doesn't give commercial bots the right to bulk-download your entire website for free. There's legal space to create a paid, registered, metered API access program — an alternative to scraping, not a replacement for FOIL.
Federal agencies already do this. PACER charges $0.10 per page. FOIA has three fee categories. DMVs sell bulk vehicle data. The precedent exists. Municipalities just haven't built the infrastructure or the legislation yet. PAID builds both.
